In the strictest sense, "SMS" never uses data, and SMS also does not require any APN settings. MMS, however, does use data. Also, if the picture is being sent as pure MMS, a cellular data connection is required as that type of message cannot be sent through wi-fi. I'm aware that there are phone software applciations that allow similar types of activities, but those aren't actually using SMS and MMS protocols. As srlawren and xCameron94x were saying, a data plan isn't required to use MMS but cellular data must be turned on in the phone.

@Bruno @MEU_21 please see @xCameron94x's response. Data must be turned on but no plan data is required not used.

I remember you need to have data enablled on your phone. You do not necessiarly need a data plan to send/receive MMS

I ran into this "problem" before. The short answer is yes, you need a data plan. I don't know much about the technical side but it seems like SMS relies on "data network" as opposed to simply an internet connection. (SMS uses APN settings whereas wi-fi does not)
