i lost/misplpaced phone, couldnt locate, tried calling several times and its off, that was may 29th. i have data charges today may 31st, how is that possible?

By any chance, are you customer at a carrier other than Public Mobile? I only ask because there are no such thing as data charges at Public Mobile. It sounds to me as if someone has been using the phone. The person could be rejecting all phone calls or may have tutned the device back on at some point since you last checked. Someone may also be using your SiM card in another device.

@Rryan1988 Log into My Account, put your phone in Lost/Stolen first. This will for sure stop any further usage
Go to Plan and Add-ons page and click on Lost/Stolen Phone to Suspend the service.
Also, you tried to locate your phone with findmyphone service: https://www.apple.com/ca/icloud/find-my/
