For some reason found my email subscribed to Telus spam emails on behalf of Public Mobile.
I never gave consent to share my personal info with anyone and never contacted Telus directly(so the only way they can get my email is Public Mobile).
I really mad at Public Mobile and thinking about suing them. Is this case have a chance in the court?

Check this site out. The spam law is very gray and really is directed towards harvesting emails and sharing information. You can complain to the spam team in the crtc.
Although right now BELL is in a class action for this exact reason.

@constantine there is a class action law suit right now agains Bell for targeted emails. But they apparently also shared customers info without asking. Spam rules in Canada have nothing to do with the initial communication. But mostly how that communication started. And also Its what happens after. So if a person asks you to stop then you have to stop. If you dont then there are repercussions according to how spam works.
Also another thing to note is the legislation has to do with commercial buisness. Key aspects of the law dont cover if you receive spam but more importantly how they have your information. Which could be through harvesting your email or creating spyware to track you for your information.

It is important that you submit your concerns about email address harvesting, spyware and other similar electronic threats to the Spam Reporting Centre.
The Spam Reporting Centre is the central repository for information about spam-related activity and threats. While a submission from a single individual about a possible contravention may not provide sufficient evidence to enable the OPC to open an investigation, the collective submissions of many Canadians will help identify possible organizations contravening the legislation which may warrant action.
Your submission may also be a matter of interest under the CASL mandates of either the CRTC or the Competition Bureau.

I'm no lawyer, but I believe this would fall under the EBR (Existing Business Relationship) clause which grants a company the implicit right to communicate with you if you are (or have been) a customer of theirs. https://crtc.gc.ca/eng/com500/guide.htm

@Spring Are you receiving emails from Telus too? Are they promotional or just information regarding the pandemic and what resources are available to customers of Telus and PM? I haven't received any promotional material from Telus, so maybe they are targeting some customers with offers and there should be an opt out if that is the case.

@Carniam Of course, you wouldn't need to see your wife's account, but I guess the question is why doesn't your wife delete those unread emails? 😊

@dabr its the wife’s account so don’t look very often. I was looking for an email recently when I figured it out and she told me if I don’t like it don’t look...
@will13am just so you know I identify as a Boeing 767 and took offence to asking people to cool their jets. Please forward your contact info so I can begin the litigation procedure

Isn't it easier just easier to delete the unwanted emails rather than seeing 2500 unread? JMO..

@constantine I think @Carniam is right and that you probably overlooked unchecking one of those boxes, but are you sure those emails are promotional from Telus? I've received a few over the last couple of months, but they've only been regarding what Telus is doing/offering during this pandemic, more of just FYI sort of emails and can be explained partly because as mentioned by @hairbag1 Telus is the parent company of PM.

@constantine , cool the jets, unsubscribe where you can and move on. Sure you could litigate anything if you like. The chances of winning and coming out ahead is pretty low. I just find using the delete button to be pretty stress free.

@Carniam I'm obsessive with unchecking those checkboxes. I always check several times for those checkboxes before I submit anything. However, many companies ignoring it and abusing personal data as they want.

@constantine if I remember correctly there was a box to click during activation regarding receiving promotional emails from PM. This box was preclicked and would have required you to unselect it. This is regular practice for many companies out there. Simply unsubscribe and that should prevent receiving any further emails.

I'm able to unsubscribe but I never subscribed to spam from PM or Telus. And as far as I know, the opt-out model is not legal in Canada. So I don't know why they misuse my personal data.

I dont think I have gotten any emails from telus or public mobile. I think in court you would have to prove that PM share your info withouth your consent. The best thing to do when you get a "spam" email....DELETE! Its no differentt then getting junk mail in your postal box...straight into the recycle bin

Have a read through the T&C's...Public Mobile is Telus.
