Do I have to upgrade to the 40$ plan to send pics otherwise it wont work on the 35$ plan

@keving in fact sending pictures via MMS is free
Make sure you have mobile data turned on, although it won't consume your data limit
if you still cannot send, let us know the error you got and also, check your APN settings

Also ensure your cellular data is on to send mms. It just has to be on and does not use data.

Sending pictures will work on any plan.
You might want to double check your APN settings. Make sure that your data is turned on.
