I know this won't make people Happy but...

Now I know we were told there would be no surprises and the price was good for as long as we were active but there is always the fine print.  Here is what I found in the ToS.  Am I happy about the price increase NO will I leave that I have to look at financially what is better for me.

Although the fine print in the service agreement give PM the right to change the terms of service, including rates, promotional material regarding the $40 plan indicated that the price would remain indefinitely as long as the account remained active.

I can't imagine any judge not siding with the consumer on this one.  If a random person comes to the PM site, gets a SIM, and takes a plan, then no guarantees.  However, that particular promotion came with its own 'agreement' that would have to supersede the basice service terms.  There is no reason a consumer should be expected to think otherwise.  The terms of the promo were clear ... No surprises...

And it DID remain the same "after your initial 90 days" It remained the same for over a year. You guys have NO case here. Its a 90 day contract and rates can be changed at any time with 30 days notice. 30 days was GIVEN. You lose! Case dismissed.

Things you need to know

 

  • This is the only promotional plan during this period. No other plans are affected
  • During the promo period, there will be two plans totaling $120: (1) the 6GB unlimited province-wide talk and global text plan and (2) the promotional plan, which has 12GB of data. Please be sure to choose the plan with twice as much data for the exact same price!
  • If you have signed up for the promotional plan, you will be able to keep it after the promo period, as long as you are an active customer. This means that, as long as you are an active customer on this plan, your plan price will remain at $120, even after your initial 90 days. No surprises.

It's that "Check out the full details below" part that's interesting as "full details" might be considered the ToS (for this particular promotion at least).

 

And for "below" there is nothing contradicting the "your plan price will remain at $120" part which sounds pretty solid.

 

On the other hand, I'm sure the actual ToS is presented when you go to sign up so.... messy stuff.

 

In any event might stir up some discussion about advertising standards and such.

I agree that it's in their terms and I believe all providers have that clause. Not that I like it, of course, but it's there.

 

However, the CCTS has commented, sorta:

In there ToS that you agreed to when you signed up would have had this included in the fine print.  Again I am not in favour of this but I am sure Telus has some pretty good high paid lawyers that would make sure it was included when you click accept ToS

@ute1978, we won't as the promo is no longer available.  Maybe they will make the whole promo disappear go back to it just being 6GB over 90 days who knows

@Kalym, the price changes in 30 days you have 28 to decide if you want the Koodo offer.

They voided that clause's applicability to the $120 plan when they explicitly stated in their promotional material that the price would stay the same so long as we kept renewing our plans. Considering that grandfathering mobile plans is common, there is a reasonable expectation that PM was serious about our rates staying the same. They have opened themselves up to a massive legal liability.

i read it too, also read - no surprises and no changes.  

 

its interesting that they are telling us that changes are effective 30 days after posting, however from now to the 15th March is 4 weeks only - thats 28 days.  So, how can they do this??
